How to Obtain a Pool Compliance Certificate in NSW

If you design a below-ground pool on your property, you will eventually have to apply for a pool safety compliance certificate.

According to Australian federal law, a new pool owner must apply for a pool compliance certificate that demonstrates your pool is safe to use and has adequate prevention in place to prevent unauthorized access by a child.

Sadly, there have been child fatalities due to drowning in residential pools, and the state government takes pool safety very seriously.

Pool Fencing

The immediate area around the pool must have a suitable barrier; a minimum height of 1200mm, as measured from ground level, actually, glass pool fencing is perfect, with panels and connectors, ensuring the fencing is secure and conforms with regulations.

The gap between the ground and the fencing should not exceed 10cm.

If a boundary fence forms part of the pool fencing, it must be at least 1.8m in height. If horizontal bars are present, they must be at least 90cm apart, so they cannot be used as climbing aids.

Non-Climbable Zone

There must be a zone around the pool that does not contain features that could aid a child climb over the barrier. This zone should extend at least 1.8m from the pool fencing and be constantly maintained.

  • Trees and shrubs – Trees, shrubs, and fauna cannot be within 90cm of the non-climbable zone.
  • All items such as chairs, tables, BBQ, toys, ladders etc cannot be closer than 90cm to the non-climbable zone.

When a pool inspector visits your property, make sure that the non-climbable zone is free from all items and conforms with state requirements.

Pool Barrier Gates

The gate must be:

  • Automatic self-closing latch.
  • The latch device must be at least 1.5m from the ground.
  • The gate must open outwardly.
  • In good working order.

Sourcing a pool fencing contractor

As you would expect, some state-approved contractors specialise in glass pool fencing and they can be located with an Internet search.

The contractor would send a representative to your home, who would help you design the perfect pool barrier that conforms with state requirements.

A quote can be issued, and if you are ready to proceed, an installation date can be scheduled, and the work can begin.

Pool Safety Inspection

Using their website, you can apply for a state official to inspect your pool at your home; if your pool meets the standards, you will be issued a pool compliance certificate that is valid for three years.

The certificate should be handed to the new owner should you sell your property, and if you acquire a property with a pool that does not have a compliance certificate, you have 90 days to make the pool compliant.

Keeping the pool area safe will bring you peace of mind, and you should never be complacent and always be aware of the risks.
